ALG's Frank Addario to Speak at National Symposium on Search & Seizure

ALG's Frank Addario is a speaker at the upcoming 20th National Symposium on Search & Seizure on February 3. Osgoode Professional Development is organizing the event, which features defence counsel, prosecutors, researchers, judges.

Frank will join Marie-Christine Godbout of Montreal's organized crime prosecution office to discuss the automatic excision rule in Charter litigation. For decades, courts have excised unconstitutionally-gathered evidence from search warrant applications. The defence bar sees the rule as preventing police from benefitting from unconstitutional investigative activity. However, some judges have criticized the rule as inflexible and ill-suited to modern criminal investigations. Frank and Ms. Godbout were counsel in the Rizzuto matter, which involved litigation over the excision rule.
