The criminal law cannot solve ubiquitous social problems. Although it’s tempting to think otherwise the prosecution of a criminal offence is a narrow exercise. When judges lose sight of the evidence in favour of “the bigger issues” wrongful convictions are sure to follow. Nowhere is this more apparent than in the charged atmosphere of sexual assault allegations.
